1. Service Overview

GymERP provides cloud-based gym management software, including member management, billing, analytics, and messaging integrations such as WhatsApp Business Platform. Access to certain features requires an active subscription.

2. Account Responsibilities

You are responsible for safeguarding account credentials, ensuring accuracy of information, and all activities conducted under your account.

3. Subscription & Payments

  • Subscriptions are billed as per the selected plan.
  • Payments are processed via secure third-party providers.
  • Failure to pay may result in suspension or termination.
  • Fees are non-refundable unless required by law.

4. WhatsApp & Messaging Usage

If you connect your WhatsApp Business account or use messaging features, you agree to comply with the policies of Meta and applicable laws including anti-spam regulations.

  • You must obtain consent before sending marketing messages.
  • You may not send unsolicited or illegal content.
  • You are responsible for message content sent to members.
  • We are not liable for misuse of messaging features.

5. Acceptable Use

You agree not to misuse the Service, attempt unauthorized access, interfere with system security, distribute harmful content, or violate applicable laws.

6. Data & Privacy

Use of the Service is also governed by our Privacy Policy. You are responsible for ensuring lawful collection and use of member data within your organization.

7. Intellectual Property

All software, branding, design, and platform content are owned by GymERP and protected under applicable intellectual property laws. Unauthorized reproduction or distribution is prohibited.

8. Limitation of Liability

The Service is provided on an “as is” and “as available” basis. We shall not be liable for indirect, incidental, consequential, or punitive damages arising from use of the Service.

9. Termination

We may suspend or terminate accounts that violate these Terms or applicable laws. Upon termination, access to certain data may be restricted.

10. Governing Law

These Terms shall be governed by the laws of India. Any disputes shall be subject to the jurisdiction of competent courts in India.
